Terms of Use

The terms for using OrnisNest: accounts, the free trial, plans and payment, your data and liability.

Draft pending legal review

This terms of use describes how OrnisNest works today. Its wording will be confirmed after legal review. Last updated 22 October 2026.

1. Acceptance of terms

These terms are an agreement between you and OrnisNest for using the OrnisNest website and app (the service). By creating an account or ticking "I agree", you accept them. If you accept them for a business, you confirm that you are authorised to bind it.

In plain language: you own your farm records, we keep them safe and available, you pay for the plan you choose, and either of us can end the agreement.

2. The service

OrnisNest helps poultry businesses record and review farm, flock and daily production records. Features marked "coming soon", "planned" or "not yet available" aren't part of the service until we release them, and we don't promise a release date. Illustrative data on our website isn't customer data or a promise of results.

OrnisNest isn't veterinary, financial or professional advice. Decisions about bird health, feed, treatment and your business are yours. Ask a qualified vet or adviser.

3. Accounts and responsibilities

  • You must be at least 18 and give accurate information.
  • Keep your password secure. You are responsible for activity on your account. Tell us right away if you suspect unauthorised access.
  • The person who creates a farm is its owner and controls who is invited, their roles, and archiving the farm. The owner is responsible for having the right to add team members' details.
  • Records a team member enters on a farm belong to that farm.

4. Free trial, plans and payment

  • New customers get a 30-day free trial, which starts when your first flock is ready for recording. You don't need payment details to start it. One trial per business.
  • Plans, allowances and prices are shown on our Pricing page. Kenyan prices are fixed in KES; other prices are charged in USD, and local-currency figures are estimates for reference.
  • M-PESA renewals need your approval from your phone each month, and we remind you before your plan expires. Card subscriptions renew automatically until cancelled.
  • A change in bird count doesn't change your bill automatically. If you go over your plan's allowance, we will ask you to review or upgrade your plan.
  • We give at least 30 days' notice of price changes, which apply from your next billing period.

If a renewal isn't paid, you have a three-day grace period. After that your account becomes read-only: you can still view your records and renew at any time. We don't delete records just because a subscription expires. You can cancel at any time and keep access until the end of the period you have paid for. Fees already paid aren't refundable, except where the law requires it.

5. Acceptable use

You agree not to break the law or enter data you have no right to use; try to access other farms' data or accounts, or probe or bypass our security; disrupt or overload the service, or use bots or scrapers without permission; resell the service without a written agreement; upload malware; or reverse engineer the service except where the law allows. We may suspend accounts that put the service or other users at risk, and where reasonable we will warn you first.

6. Your data

You own your farm records. You give us permission to host, process and display them only as needed to provide, secure and support the service. We don't sell your data. Our Privacy Policy explains how we handle personal data and forms part of these terms. You are responsible for the accuracy of the records you enter.

7. Availability and intellectual property

We work to keep OrnisNest available but don't guarantee uninterrupted service; maintenance, internet outages and our providers can cause downtime. We may improve, change or retire features, and if we remove a core feature you pay for, we will give reasonable notice and you can cancel.

We own the service, including its software, design and brand. These terms give you a limited, non-exclusive, non-transferable right to use it during your subscription. If you send us feedback, we may use it without obligation to you.

8. Limitation of liability

The service is provided as is, to the extent the law allows. We are not liable for indirect or consequential loss, such as lost profits, lost birds or production, or business interruption. Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't be limited under Kenyan law, including your rights under the Consumer Protection Act, 2012.

9. Ending the agreement and changes

You can close your account at any time by contacting us. We may end these terms on 30 days' notice, or immediately for serious breach. We give at least 30 days' notice of material changes to these terms by email or in the app.

These terms are governed by the laws of Kenya. If there's a dispute, we will first try to resolve it in good faith within 30 days; after that, the courts of Kenya have jurisdiction.
